The Frankie Dettori NHS Raffle Prize Draw Terms & Conditions

These Terms and Conditions serve in addition to the Terms & Conditions that govern your use of the Racehorse Lotto website and entry in to all Prize Draws that Racehorse Lotto operates including this Raffle Prize Draw.
THE FRANKIE DETTORI NHS RAFFLE PRIZE DRAW RULES
The following describes the rules and procedures by which Racehorse Lotto operates The Frankie Dettori NHS Raffle Prize Draw and determines the winner.
Timing of the Raffle Prize Draw
The Raffle Prize Draw will be open for entry from the 30th April 2020 to 31st May 2020.
Racehorse Lotto will perform the Raffle Prize Draw on or after 1st June 2020. Racehorse Lotto may extend the date and time that the Raffle Prize Draw is open for entries and the date and time that it performs the Raffle Prize Draw at any time and at its sole discretion.
The date and time of the Raffle Prize Draw will always be available on the website and made known to customers prior to purchasing any entries in to that Raffle Prize Draw.
Raffle Prize Draw Entries
Raffle Prize Draw entries are allocated a unique identifier upon purchase or processing of a postal entry.
Raffle Prize Draw entries submitted via the postal entry method must be received by 31st May 2020. Postal entries received after this date will not be entered in to the Raffle Prize Draw.
There is no limit on the number of entries that each player can make.
Eligibility to enter is limited to those who are at least 18 years old and resident in the UK, excluding Northern Ireland.
No entries from agents, third parties, syndicated entries or those made using methods such as a computer macro, script or the use of automated devices are permitted and no bulk entries are permitted.
Conducting Raffle Prize Draws
From midnight on the 31st May 2020 onwards no further entries in to this Raffle Prize Draw will be possible. The winning entry for a Raffle Prize Draw will never be determined until we have verified that no further entries are able to enter in to the Raffle Prize Draw.
Once all entries have been confirmed and the Raffle Prize Draw is locked down, Racehorse Lotto will use an independent certified draw provider to pick a single winning entry from all of the entries in the Raffle Prize Draw.
NHS Charities Together donation
Racehorse Lotto strives to support the NHS during these very difficult times. To this end Racehorse Lotto will donate 100% of all paid entry fees to the NHS Charities Together COVID-19 Appeal.
No donations will be made in respect of entries made using the alternative postal method of entry.
Racehorse Lotto does not claim ownership or affiliation with the NHS, NHS Charities Together, and their trade names, logos or intellectual property.
The portion of paid entry fees that will be donated to NHS Charities Together will be made available on the Site.
The specific amount raised for and donated to NHS Charities Together from the Raffle Prize Draw will be made available on the Site and Racehorse Lotto's social media channels after the Prize Draw has concluded.
The Prize
The prize is made up of several distinct parts, detailed below.
Become a racehorse owner for the day
The Raffle Prize Draw winner will have a racehorse winner running in their name and their own racing colours.
The horse will race in one flat race in 2021 and be ridden by top jockey Frankie Dettori.
The winner will be given four (4) owners and trainers badges for the day of the race so that they can invite friends and family to attend the racecourse for free.
Newmarket experience
Two nights stay in a luxury hotel in Newmarket.
A tour of the Jockey Club training grounds and gallops in Newmarket.
A behind the scenes tour of one of Newmarket's racing stable yards.
A tour of the National Stud.
A visit to the Palace House: National Heritage Centre for Horseracing & Sporting Art museum and gallery.
Champagne afternoon tea & tour at the luxurious Jockey Club Rooms.
Delivery of the Prize
The winner of the prize will be contacted via their registered email address and/or phone number if it has been provided to us to arrange for delivery to them. The winner will not be liable for any postage costs or any other fees incurred in delivering the prizes to them. We may ask if the winner would be willing to participate in a photo shoot with their prize for our promotional purposes. If the winner agrees then we will deliver the prize to them at a date and time that we agree upon together. The winner will in no way be obligated to do this. Racehorse Lotto reserves the right to substitute all or part of the prize with an alternative prize of equal or greater value where it is unable to provide the listed prize to a winner. No cash prize alternative is available for the prize except where stated in these Terms & Conditions.
We will endeavour to provide the prize to the winner as soon as reasonably practicable. However, if we reasonably consider that we are not able to provide the prize in the form described under these Terms for reasons outside of our control (including epidemic, pandemic, disease (including equine diseases), injury or death to racehorses, cancellation or postponement of sporting events, acts of God, flood, drought, earthquake or other natural disaster, terrorist attack, riots, war, fire, explosion or accident or any law or any action taken by a government or public authority) we shall not be obliged to provide the prize to the winner from the start of such event until we reasonably consider that (i) the event outside of our control has ended; and (ii) we are able to provide the prize substantially in the form described under these Terms.
If, for any reason, a horse race in England and Wales is conducted at a racecourse that is closed to the public or otherwise subject to enhanced entry restrictions, we may, but we shall not be obliged to, provide prizes in respect of horse races that are conducted in such stadiums.
To the extent applicable, the period during which the winner may receive the prize may be extended by: (i) the period that we consider that the event outside of our control prevented the prize from being provided to the winner substantially in the form described; and/or (ii) the period during which horse races in England and Wales are conducted at racecourses that are closed to the public or otherwise the subject of enhanced entry restrictions.
No payment will be required from the winner in order to receive the prize.
We may require proof of identity and to perform other checks prior to delivering the prize.
In the event that it is not possible for us to contact a winner to arrange delivery of a prize after multiple attempts, then after a period not shorter than one month from the first attempted contact the prize will be deemed to be forfeited by the winner.
If any individual element of a prize has not been claimed, booked or selected (as appropriate) by the timescale set out in these Terms, that element of the prize will be deemed to be forfeited by the winner. For the avoidance of doubt, this will not affect other elements of the prize that (i) have been claimed, booked or selected by the winner within the appropriate timescale; and (ii) the Racehorse Lotto considers are not dependent upon the forfeited element of the prize. By way of example only, if the winner does not select racehorse colours (defined below) within a period of two years of winning the prize, the winner would no longer be able to select the racehorse colours of their choice but would still be able to receive all the other elements of the prize.
A horse racing in your name ridden by Frankie Dettori
Racehorse Lotto will ensure that one (1) thoroughbred racehorse will be made available to race in the name and racing colours of the winner for one (1) day at one (1) flat race that takes place in 2021. The horse will be ridden by Frankie Dettori.
The date, racecourse, horse, handicap and race that the horse runs in the winner's name will all be determined at the sole discretion of Racehorse Lotto.
In the event that it is not possible for Frankie Dettori to ride the horse on the day of the race for any reason, Racehorse Lotto will first endeavour to find another suitable date and race where Frankie Dettori will be able to ride a horse racing in the winner's name. Where this is not possible Racehorse Lotto will find another jockey to ride the horse.
The horse will be managed under a lease agreement ("Lease") which will be signed between the racehorse owner ("Owner") and the Raffle Prize Draw winner. The Lease must be signed by the winner within a period two (2) years of winning the prize. Under this agreement Racehorse Lotto will ensure that the winner has access to one (1) horse for one (1) day. If for some reason this horse is unable to race Racehorse Lotto will ensure that another horse will be made available to race in the name of the winner unless the following sentence applies. If the horse is withdrawn from a race within one week of a race day for any reason Racehorse Lotto makes no guarantee that a replacement horse will be available to run in the name of the winner for that race. Where this occurs Racehorse Lotto will endeavour to identify an alternative race date.
The winner shall be responsible for the registration of the Lease with Weatherbys Racing Bank ("Weatherbys") within the applicable time frame and in compliance with the Rules of Racing of the British Horseracing Authority ("Rules of Racing"). Racehorse Lotto will ensure that the Owner shall provide such assistance as may reasonably be requested by the winner or by Weatherbys to confirm the same.
The lease of the horse under the Lease will run for a period of one (1) day ("Lease Period"). This contract will start and end on the date that the horse is scheduled to race in the winner's name.
Each party shall be responsible for obtaining their own insurance in respect of their potential liabilities under or in connection with the Lease.
Racehorse Lotto shall arrange for the winner to obtain and maintain at all times during the Lease Period third party liability insurance cover in the form and to the limit of liability provided by the Racehorse Owners Association. Racehorse Lotto or one of its affiliates will pay for all the costs of such insurance and shall be liable for the payment of insurance premium. The third party liability insurance cover will cover the Owner and the winner. The winner will provide the Owner with a copy of the insurance policy document(s) promptly upon receipt.
Your own registered racing colours of your choice
The winner may choose their own racing colours, or 'silks'. These are the racing colours that will be worn by the jockey racing the horse won under this prize.
No two sets of colours can be exactly the same. Each racing colour submission received will be first considered by British Horseracing Authority judges and Weatherbys to ensure the colours do not clash with any other silks. The final decision on registrations rests solely with the British Horseracing Authority.
The full costs to register and purchase the colours will be borne by Racehorse Lotto or one of its affiliates.
The racing colours must be selected by the winner within two years of winning the prize.
Exclusive access at the racecourse with four Owners & Trainers badges
By becoming the 'owner' of a racehorse under the Lease the winner will be given up to four Owners & Trainers badges to be used to access the racecourse on the day their horse is racing. These badges can be used to invite friends and family to attend racing days with the winner. These badges can only be used on the day the horse is racing at the racecourse where the horse is running.
Newmarket Experience
The winner plus up to one (1) other person will be able to visit Newmarket and tour various horseracing related premises and museums. Both the winner and their guest must make the visit together on the same date and at the same time.
The date, time and itinerary of the visit will be determined at the sole discretion of Racehorse Lotto.
The winner and their guest will stay for two nights at a luxury hotel in Newmarket. The hotel will be selected by Racehorse Lotto or one of its affiliates.
The winner and their guest will receive a tour of the Jockey Club training grounds and gallops in Newmarket.
The winner and their guest will receive a behind the scenes tour of one of Newmarket's racing stable yards.
The winner and their guest will receive a tour of the National Stud.
The winner and their guest will receive a visit to the Palace House: National Heritage Centre for Horseracing & Sporting Art museum and gallery.
The winner and their guest will receive a champagne afternoon tea & tour at the luxurious Jockey Club Rooms.
Where one or more elements of this Newmarket itinerary is unable to happen due to circumstances outside of Racehorse Lotto's control, the remaining elements of the itinerary will go ahead as planned, and the elements that did not happen shall be forfeit. Racehorse Lotto shall endeavour to, but makes no guarantee to, include substitue elements of a similar nature and value to any elements that were unable to go ahead.
The full cost of this visit will be borne by Racehorse Lotto or one of its affiliates, including train tickets to and from Newmarket and travel within and around Newmarket for the various elements of the itinerary.
Miscellaneous rules
Racehorse Lotto and any affiliated parties, for example good causes recipients are not responsible for illegible, lost, late, incomplete, misdirected, or undeliverable email; or for any computer, telephone, satellite, cable, network, electronic or internet hardware or software malfunctions, failures, connections, or availability, or garbled, corrupt or jumbled transmissions, service provider/internet/website/use net accessibility, availability, or traffic congestion, or any technical, typographical, or other error, or unauthorised human intervention, or the incorrect or inaccurate capture of registration information, or the failure to capture, or loss of, any such information.
By entering The Raffle Prize Draw, you agree to be bound by these Raffle Prize Draw Rules and by all applicable laws and decisions of Racehorse Lotto.
In the event of a dispute regarding entries received from multiple users having the same email account, the authorised subscriber of the email account at the time of entry will be deemed to be the entrant and must comply with these rules. Authorised account subscriber is the natural person who is assigned the email address by the Internet Service Provider (ISP), online service provider, or other organisation responsible for assigning email addresses.
Promotion of the Raffle Prize Draw Winner
The name and likeness of the Raffle Prize Draw winner may be used by Racehorse Lotto or its affiliates for promotional purposes. This will be subject to the consent of the winner. Where this consent has been given, the winner will not be entitled to any further compensation for the use of this content in any promotional materials published on or offline.
