The Mark Johnston Racing Raffle Terms & Conditions

These Terms and Conditions serve in addition to the Terms & Conditions that govern your use of the Racehorse Lotto website and entry in to all Prize Draws that Racehorse Lotto operates including this Prize Draw.
THE MARK JOHNSTON RACING RAFFLE RULES
The following describes the rules and procedures by which Racehorse Lotto operates The Mark Johnston Racing Raffle and determines the winners.
Timing of the Prize Draw
The Raffle will be open for entry from the 17th August 2020 to the 19th October 2020.
Racehorse Lotto will perform two Raffle Prize Draws, an Early Bird Prize Draw and a Main Prize Draw. The Early Bird Prize Draw will take place on 1st September. The Main Prize Draw will take place on 20th October 2020.
The dates and times of the Raffle Prize Draws will always be available on the website and made known to customers prior to purchasing any entries in to those Raffle Prize Draws.
Raffle Prize Draw Entries
Raffle Prize Draw entries are allocated a unique identifier upon purchase or processing of a postal entry.
Raffle Prize Draw entries submitted via the postal entry method must be received by 19th October 2020 to be entered in to the Main Prize Draw, and by 31st August 2020 to be entered in to the Early Bird Prize Draw. Postal entries received after these dates will not be entered in to the respective Raffle Prize Draws.
There is no limit on the number of entries that each player can make.
Eligibility to enter is limited to those who are at least 18 years old and resident in the UK.
No entries from agents, third parties, syndicated entries or those made using methods such as a computer macro, script or the use of automated devices are permitted and no bulk entries are permitted.
Conducting Raffle Prize Draws
All entries received by midnight on the 31st August 2020 will be eligible for the Early Bird Prize Draw in addition to the Main Prize Draw. All entries received after midnight on the 31st August 2020 will be eligible for the Main Prize Draw only.
On 1st September 2020, Racehorse Lotto will use an independent third-party service to randomly pick a single winning entry for the Early Bird Prize from all of the entries in the Raffle Prize Draw that were received before midnight on 31st August 2020.
From midnight on the 19th October 2020 onwards no further entries in to this Raffle Prize Draw will be possible. The winning entry for the Main Prize Draw will not be determined until we have verified that no further entries are able to enter in to the Raffle Prize Draw.
Once all entries have been confirmed and the Raffle Prize Draw is locked down, Racehorse Lotto will use an independent third-party service to randomly pick a single winning entry from all of the entries in the Raffle Prize Draw to be the winner of the Main Prize.
Racing Welfare donation
Racehorse Lotto strives to support the racing industry during these very difficult times. To this end Racehorse Lotto will donate 20% of the purchase price of every Raffle ticket to Racing Welfare.
No donations will be made in respect of entries made using the alternative postal method of entry.
Racehorse Lotto does not claim ownership or affiliation with Racing Welfare, and its trade names, logos or intellectual property.
The portion of paid entry fees that will be donated to Racing Welfare will be made available on the Site.
The specific amount raised for and donated to Racing Welfare from the Raffle Prize Draw will be made available on the Site and Racehorse Lotto's social media channels after the Prize Draw has concluded.
The Prizes
Main Prize - One 5% Share in a Kingsley Park 20 racing partnership from Mark Johnston Racing.
The Raffle Prize Draw winner will win one (1) five percent (5%) share in a Kingsley Park 20 racing partnership from Mark Johnston Racing.
Racehorse Lotto will bear all of the costs for participation in the partnership on behalf of the winner. The expected value of the prize is £12,975. The final value is subject to how many of the three horses in the partnership are taken forward to a second year of racing.
Participation in the partnership will be subject to a contract with Mark Johnston Racing. It shall be the responsibility of the winner to meet the terms of the contract.
Travel costs to and from the training yard to visit the horses in the partnership and to any races that they participate in are the responsibility of the winner.
In the event that it is not possible to provide the winner with a share in the partnership for any reason outside of Racehorse Lotto's control then an alternative prize of equivalent financial value will be awarded, determined at the sole discretion of Racehorse Lotto.
Early Bird Prize - Tour of Kingsley Park training yard.
The Early Bird Raffle Prize Draw winner and one guest will win a tour of Mark Johnston's training yard - Kingsley Park.
The tour shall be arranged for a date in September, subject to availability.
Racehorse Lotto will bear the cost of train tickets to and from the training yard for the winner and one guest.
Lunch will be provided during the tour.
Delivery of the Prizes
The winner of the prizes will be contacted via their registered email address and/or phone number if it has been provided to us to arrange for delivery to them. The winner will not be liable for any postage costs or any other fees incurred in delivering the prizes to them. We may ask if the winner would be willing to participate in a photo shoot with their prize for our promotional purposes. If the winner agrees then we will deliver the prize to them at a date and time that we agree upon together. The winner will in no way be obligated to do this. Racehorse Lotto reserves the right to substitute all or part of the prize with an alternative prize of equal or greater value where it is unable to provide the listed prize to a winner. No cash prize alternative is available for the prize except where stated in these Terms & Conditions.
We will endeavour to provide the prize to the winner as soon as reasonably practicable. However, if we reasonably consider that we are not able to provide the prize in the form described under these Terms for reasons outside of our control (including epidemic, pandemic, disease (including equine diseases), injury or death to racehorses, cancellation or postponement of sporting events, acts of God, flood, drought, earthquake or other natural disaster, terrorist attack, riots, war, fire, explosion or accident or any law or any action taken by a government or public authority) we shall not be obliged to provide the prize to the winner from the start of such event until we reasonably consider that (i) the event outside of our control has ended; and (ii) we are able to provide the prize substantially in the form described under these Terms.
If, for any reason, a horse race in England and Wales is conducted at a racecourse that is closed to the public or otherwise subject to enhanced entry restrictions, we may, but we shall not be obliged to, provide prizes in respect of horse races that are conducted in such stadiums.
To the extent applicable, the period during which the winner may receive the prize may be extended by: (i) the period that we consider that the event outside of our control prevented the prize from being provided to the winner substantially in the form described; and/or (ii) the period during which horse races in England and Wales are conducted at racecourses that are closed to the public or otherwise the subject of enhanced entry restrictions.
No payment will be required from the winner in order to receive the prize.
We may require proof of identity and to perform other checks prior to delivering the prize.
In the event that it is not possible for us to contact a winner to arrange delivery of a prize after multiple attempts, then after a period not shorter than one month from the first attempted contact the prize will be deemed to be forfeited by the winner.
If any individual element of a prize has not been claimed, booked or selected (as appropriate) by the timescale set out in these Terms, that element of the prize will be deemed to be forfeited by the winner. For the avoidance of doubt, this will not affect other elements of the prize that (i) have been claimed, booked or selected by the winner within the appropriate timescale; and (ii) the Racehorse Lotto considers are not dependent upon the forfeited element of the prize.
Miscellaneous rules
Racehorse Lotto and any affiliated parties, for example good causes recipients are not responsible for illegible, lost, late, incomplete, misdirected, or undeliverable email; or for any computer, telephone, satellite, cable, network, electronic or internet hardware or software malfunctions, failures, connections, or availability, or garbled, corrupt or jumbled transmissions, service provider/internet/website/use net accessibility, availability, or traffic congestion, or any technical, typographical, or other error, or unauthorised human intervention, or the incorrect or inaccurate capture of registration information, or the failure to capture, or loss of, any such information.
By entering The Raffle Prize Draw, you agree to be bound by these Raffle Prize Draw Rules and by all applicable laws and decisions of Racehorse Lotto.
In the event of a dispute regarding entries received from multiple users having the same email account, the authorised subscriber of the email account at the time of entry will be deemed to be the entrant and must comply with these rules. Authorised account subscriber is the natural person who is assigned the email address by the Internet Service Provider (ISP), online service provider, or other organisation responsible for assigning email addresses.
Promotion of the Raffle Prize Draw Winner
The name and likeness of the Raffle Prize Draw winners may be used by Racehorse Lotto or its affiliates for promotional purposes. This will be subject to the consent of the winners. Where this consent has been given, the winners will not be entitled to any further compensation for the use of this content in any promotional materials published on or offline.
