INTRODUCTION

Racehorse Lotto is an associated brand of, and operated by, Furlong Gaming Limited (registered in England & Wales, company number 11906850) and registered address Elsley Court, 20-22 Great Titchfield Street, London, United Kingdom, W1W 8BE) (Racehorse Lotto, we, or us).

Please read these terms and conditions (this Agreement) carefully as it is a legally binding contract between you and us.

This Agreement sets forth the terms and conditions under which Racehorse Lotto provides you access to, and governs your use of, the website located at racehorselotto.com (the Site) and the information, content, features and services provided through the Site.

Your use of the Site, or by clicking "I accept" (or equivalent phrase) if presented with this Agreement in a click-through format, signifies and constitutes your binding acceptance of this Agreement. If you do not accept, you may not use the Site or the services that we provide on the Site.

You may not use the Site and you may not accept this Agreement if you are not at least 18 years old and resident in the United Kingdom. If you accept this Agreement, you represent that you have the legal capacity to be bound by it. Racehorse Lotto may amend this Agreement at any time by posting the amended terms and conditions on the Site, and you agree that you will be bound by any changes to this Agreement if you continue to use the Site and/or our services. Please check this Agreement regularly to ensure that you understand the terms that apply at the time that you access and use the Site. The date of last revision of this Agreement was the date stated at the top of this page. Racehorse Lotto may make changes to the Site at any time. You understand that Racehorse Lotto may discontinue or restrict your use of the Site for any reason or no reason with or without notice.

When certain words and phrases are used in this Agreement, they have specific meanings (these are known as "defined terms"). You can identify these defined terms because they start with capital letters (even if they are not at the start of a sentence). Where a defined term is used, it has the meaning given to it in the section of this Agreement where it was defined (you can find these meanings by looking at the sentence where the defined term is included in brackets and bold text).

1. OUR STATUS

We do not promote a lottery and are not lottery promoters.

We are not a gambling or gaming company requiring a licence from the Great Britain Gambling Commission.

Racehorse Lotto operates and makes entry available in to regular prize draws as further set out in this Agreement (Prize Draws). Racehorse Lotto does not require a licence to operate the Prize Draws and the Prize Draws do not constitute gambling.

We provide alternative methods of entry in to all of the Prize Draws we make available that do not require a payment to enter. All entries made using any alternative methods of entry are treated the same as any paid entries and have an equal chance of winning a prize as any paid entries in Prize Draws that they are entered in to. Payment will never be required for entrants using the alternative entry method to find out if they have won a prize or to receive a prize.

2. PRIVACY POLICY

Please refer to our Privacy Policy, which governs the collection and use of your personal data. Racehorse Lotto may revise the Privacy Policy at any time, and the new versions will be posted on the Site. If at any point, you do not agree to any portion of the Privacy Policy, you must immediately stop using the Site.

3. THE SITE

The Site is directed at people residing in the United Kingdom. We do not offer any guarantee that the Site, or any content on it, is appropriate for use or available in other locations. The Site provides Prize Draws for a chance to win a variety of prizes (Prizes) that may change from Prize Draw to Prize Draw. Participants may enter Prize Draws by creating an Account (defined below) and then either (i) purchasing entries in the Prize Draws or; (ii) by using Racehorse Lotto's alternate method of entry. No other purchase, payment or other financial contribution is necessary to enter or win a Prize Draw, and any and all Prize Draws are void where prohibited by law.

Racehorse Lotto reserves the right to add, change, modify, suspend or discontinue any portion of the Site, in its sole discretion, at any time. Your use of the Site, including the availability of new functionality made available through the Site from time to time, shall be subject to this Agreement. In addition, Racehorse Lotto may impose limits on any portion of the Site or restrict your access to portions of the Site in its sole discretion without notice or liability.

4. PURCHASING ENTRIES

In addition to at least one alternative method of entry, each Prize Draw allows purchasing entries for chances to win the Prizes on offer for that Prize Draw. The pricing and availability of entries is subject to change and may vary from one Prize Draw to the next. All prices will be made clear prior to purchase.

5. ALTERNATIVE METHOD OF ENTRY - POSTAL ENTRIES

Racehorse Lotto offers an alternative method of entry to its Prize Draws via a postal method that does not require payment to enter. All entries made using the postal entry method must be linked to a verified user Account and therefore requires entrants to register for an Account on the Site prior to sending any postal entries to Racehorse Lotto.

Postal entries must include the following information to be deemed valid:

  • Unique ID (found in the Account section of the Site when logged in)
  • Full name (written in block capital letters)
  • Phone number (including country code)
  • Email address
Postal entries for any Raffle Prize Draws must also include the name of the Prize Draw in capital letters in addition. The name will be clearly indicated on the Raffle Prize Draw entry page. This information can either be written on a postcard or on a piece of paper placed inside a sealed envelope. Send the postcard or sealed envelope containing the ID and other required information to the following address via either first or second class post:

A maximum of one entry can be made per postcard or envelope received.

If a postcard or envelope is sent with more than one unique ID written on it or contained within then only one of them will be processed and all others will be deemed invalid.

If there are multiple differing unique IDs written on a single postcard or contained within a single envelope then which one is picked will be at the sole discretion of Racehorse Lotto.

Entries received by post will be processed within five working days of receipt by Racehorse Lotto.

Numbers will be randomly generated using a software random number generator for all postal entries.

Customers are not able to request specific numbers to be used, or amend them once they have been generated.

Once a postal entry has been processed it will be entered in to the next available draw for which the cut-off time has not yet passed.

Alternative entries are treated identically to paid entries for the purposes of determining a winner, and have an equal chance of winning as any paid entries.

If an alternative entry wins a prize there will be no further purchase or payment necessary to be notified of the win or to receive the prize.

If any of the required information that is written on a postal entry is illegible or does not match the details of a user account in our system then the entry will be deemed invalid.

No notification will be given to players if a postal entry is deemed invalid.

6. REFERRAL ENTRIES

Racehorse Lotto may make available from time to time reward schemes for customers that successfully invite other customers to play. Where such a reward scheme involves awarding free entries to either the inviter, invitee, or both, the reward will be subject to the following requirements:

  1. The inviter must be a registered customer with a valid Racehorse Lotto Account.
  2. The invitee registered for an Account with Racehorse Lotto for the first time using the inviter's referral link.
  3. The invitee had not previously registered for an Account using another customer's referral link.
  4. The invitee successfully purchases at least one paid entry in to a Prize Draw.

If the above requirements are met, then the reward to the inviter, invitee, or both will be attributed to their Account(s) within five working days of the date of first paid entry purchase by the invitee.

Prize Draw entries awarded to customers for referrals have no cash value and are not redeemable for cash under any circumstances. The numbers used for any entries awarded in these circumstances will be generated randomly and customers will not be able to choose the numbers used for these entries.

Racehorse Lotto reserves the right to remove, amend or otherwise alter any referral reward schemes at any time and without notice.

Where it is found that a referral reward scheme is being abused through the use of multiple Accounts for the same individual, or any other means, then Racehorse Lotto reserves the right at its sole discretion to close the Accounts of the offenders and revoke any entries awarded.

7. ENTRIES AWARDED AS PRIZES

Racehorse Lotto may award entries in to an upcoming Prize Draw as prizes in an earlier Prize Draw. Prize Draw entries awarded to customers as Prizes have no cash value and are not redeemable for cash under any circumstances. The numbers used for any entries awarded in these circumstances will be generated randomly and customers will not be able to choose the numbers used for these entries.

8. SUBSCRIPTION ENTRIES

Racehorse Lotto provides the option to purchase entries on a subscription basis. Where this is made available as an option, the price and payment frequency will be made clear and you must explicitly opt-in to subscription payments. If you enable subscription for a given entry purchase then the Racehorse Lotto system will charge your payment method and purchase the same entry numbers for all relevant Prize Draws while the subscription remains active.

You will be able to view a history of your subscription payments in your Account.

In order to process your subscription payments we will store a unique token representing your payment information as stored by our PCI Compliant third party payment provider. This token will be used to perform cardholder not present transactions using your payment information each time a payment is due for your subscriptions.

9. SUBSCRIPTION CANCELLATIONS

Subscriptions may be cancelled at any time from your Account. If you cancel a subscription then you will no longer be charged automatically for that particular subscription with immediate effect.

10. SUBSCRIBER EXCLUSIVE BENEFITS

Racehorse Lotto may from time to time offer additional benefits to players who purchase entries on a subscription basis.

These additional benefits will be made clear to you prior to purchasing entries and during subsequent communications with you.

Racehorse Lotto reserves the right to alter, amend or withdraw these benefits at any time and without notice to you.

These benefits shall not confer any advantage or altered chance of winning Prizes in our Prize Draws compared to entries not purchased on a subscription basis.

Betting Tips

On Saturday and Sunday every week, players with an active Lotto subscription that is in good standing with regards to payment shall receive an email in the morning containing betting tips for a selection of horse races happening that day provided by Quentin Franks Racing.

These betting tips are provided to subscribers on a best effort basis and Racehorse Lotto shall not be responsible or liable in any way if tips are not provided on a given day for any reason.

These betting tips are non-transferable and cannot be exchanged for money or any other benefit.

These betting tips are for personal use only and may not be resold.

Racehorse Lotto provides no warranties or guarantees with regards to the quality of the tips. Bets made using the provided tips are made solely at the risk of the better and Racehorse Lotto shall not be liable for any losses incurred making such bets.

11. REFUNDS

Racehorse Lotto Prize Draw entries that have been purchased using the Site or via subscription are non-refundable under normal circumstances. In the event that Racehorse Lotto has to cancel a Prize Draw after entries have already been purchased then the amounts paid will be refunded to the payment methods used to purchase those entries.

12. INTERNET ACCESS

You are responsible for any Internet connection and telecommunication fees and charges that you incur when accessing the Site.

13. ACCOUNTS

To use certain portions of the Site, you will be directed to register on the Site and create a user profile or account (Account). Eligibility is limited to those who are at least 18 years old and resident in the UK. As part of the registration process, you will be required to provide personal information including contact details. You agree that all information you provide to Racehorse Lotto for the purposes of creating an account (Registration Information) will be true, accurate, current and complete and your failure to provide such information shall constitute a breach of this Agreement and may result in the immediate termination of your Account. You shall (i) promptly update your Registration Information to keep it true, accurate, current and complete; and (ii) maintain the confidentiality of your password. We only use your personal information in accordance with our Privacy Policy (available at www.racehorselotto.com/privacy-policy).

In creating an Account, you shall not (a) select or use the email address or user name of another person with the intent to impersonate that person, (b) use a name subject to the rights of any other person without authorisation, (c) use an email address or username that is profane, offensive or otherwise inappropriate or (d) allow any other party to use your Account and/or password except as set forth herein.

You may not share or transfer any Account. You may not disclose your password to anyone. You agree to immediately notify Racehorse Lotto by sending an email to info@racehorselotto.com of any known or suspected unauthorised use(s) of your Account or any known or suspected breach of security, including loss, theft or unauthorised disclosure of your password. You understand and agree that you shall be liable for all activities that occur under any Account created for your use, even if such activities were not committed by you. Racehorse Lotto is not responsible for any loss or damage arising from your failure to maintain the confidentiality of your password.

Employees, agents, successors, and assignees of Racehorse Lotto, its advertising agencies and promotional companies involved in any of the Prizes Draws on the Site, as well as family and household members of same, shall be ineligible to participate in and ineligible to win prizes in any of the Prize Draws made available on the Site.

14. TERMINATION OF ACCOUNT

You understand and agree that you have no ownership rights in your Account and Racehorse Lotto may prevent access to the Site at any time. Further, Racehorse Lotto may cancel your Account, delete all of your Registration Information and any other information you have provided through the Site (collectively, User Content) associated with your Account at any time, without notice, for any reason or no reason including, without limitation, your breach of this Agreement. Racehorse Lotto will not be liable for any damages or loss resulting from the removal of any User Content from the Site. You may cancel your Account at any time and cancellation will take effect immediately. Racehorse Lotto reserves the right to temporarily or permanently restrict or block access to the Site to any users.

15. LIMITED LICENCE TO USE SITE

Subject to all of the terms and conditions of this Agreement, Racehorse Lotto hereby grants you a limited, non-exclusive, personal, non-sublicensable, non-assignable licence to access and use the Site. The Site may only be used for personal and non-commercial purposes and must at all times be used in accordance with this Agreement and rules, restrictions and/or documentation set forth by Racehorse Lotto from time to time. All modifications and enhancements to the Site remain the sole property of Racehorse Lotto. You agree not to licence, create derivative works from, transfer, sell or re-sell any information, content, or services obtained from the Site. You understand that Racehorse Lotto, in its sole discretion, may at any time for any reason suspend or terminate any licence hereunder and disable the Site, or any part thereof, without prior notice. Racehorse Lotto reserves the right to add or remove features or functions to the Site at any time in its sole discretion. Notwithstanding anything to the contrary herein, you may not: (i) cause, permit or authorise the modification, creation of derivative works, translation, reverse engineering, decompiling, disassembling or hacking of the Site; (iii) sell, assign, rent, lease, or grant rights in the Site, including, without limitation, through a sublicence, to any other entity without the prior written consent of Racehorse Lotto; or (iv) make any false, misleading or deceptive statement or representation regarding Racehorse Lotto and/or the Site.

16. USE OF SITE AND SERVICE

You agree that you will not, in connection with your use of the Site, breach any applicable law or regulation. Without limiting the foregoing, you agree not to (i) make available through the Site any material or information that infringes any copyright, trademark, patent, trade secret, or other right of any party (including rights of privacy or publicity); (ii) institute, assist, or become involved in any type of attack including, without limitation, denial of service attacks, upon the Site or otherwise attempt to disrupt the Site or any other person's use of the Site; or (iii) attempt to gain unauthorised access to the Site, Accounts registered to other users, or the computer systems or networks connected to the Site. Furthermore, you may not use the Site to develop, generate, transmit or store information that: (a) is defamatory, harmful, abusive, obscene, hateful, offensive or racist and it must not promote or propose hatred or physical harm against anyone; (b) promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age; (c) promotes or condones terrorism, violence or illegal behaviour; (d) in any way obstructs or otherwise interferes with the normal performance of another person's use of the Site, (e) uses the material or content or infringes the rights or privacy of anyone else; for example you should not use images or well-known characters, footage or music (unless it is your own); (f) performs any unsolicited commercial communication not permitted by applicable law; (g) constitutes harassment or a breach of privacy or threatens other people or groups of people; (h) is harmful to children in any manner; (i) breaches any applicable law, regulation or ordinance; (j) makes any false, misleading or deceptive statement or representation regarding Racehorse Lotto and/or the Site; or (k) constitutes phishing, pharming or impersonates any other person, or steals or assumes any person's identity (whether a real identity or online nickname or alias).

You agree that you will not (i) obtain or attempt to obtain any information from the Site including, without limitation, email information of other Account holders or other data; (ii) intercept, examine or otherwise observe any proprietary communications protocol used by the Site, whether through the use of a network analyser, packet sniffer or other device; or (iii) use any type of bot, spider, virus, clock, timer, counter, worm, software lock, drop dead device, Trojan-horse routing, trap door, time bomb or any other codes, instructions or third-party software that is designed to provide a means of surreptitious or unauthorised access to, or distort, delete, damage or disassemble, the Site.

You understand that all user-generated data, information, text, software, graphics, video, messages, tags, or other materials (Content), whether publicly posted or privately transmitted, on the Site or through the use of the Site, are the sole responsibility of the person posting or transmitting such Content. Racehorse Lotto does not control the Content posted on the Site or transmitted through the use of the Site and, as such, Racehorse Lotto does not guarantee, and shall not be responsible for any deficiencies relating to, the accuracy, reliability or quality of such Content. Further, you acknowledge that Racehorse Lotto may or may not pre-screen Content that is displayed on the Site or transmitted through the use of the Site. You understand that by visiting the Site, you may be exposed to Content that you may consider to be offensive, indecent or objectionable. Under no circumstances will Racehorse Lotto be liable in any way for any user-generated Content including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available on the Site or through the use of the Site.

The Site may provide forums and/or chat features enabling users to post user observations and comments. We cannot guarantee that other members or users will not use the ideas and/or information that you share. If you have ideas and/or information that you want to remain confidential and/or do not want others to use, do not post them via the Site. We shall have no responsibility to evaluate, use or compensate you for any ideas and/or information that you submit on the Site or through the use of the Site.

All comments, feedback, suggestions, ideas, and other submissions that you disclose, submit or offer to us in connection with your use of the Site, such as your suggestions regarding improvements that we make to the Site (collectively, Comments) will become our exclusive property. Such disclosure, submission or offer of any Comments shall constitute an assignment to us of all worldwide right, title and interest in all patent, copyright, trademark, and all other intellectual property and other rights whatsoever in and to the Comments and a waiver of any claim based on moral rights, unfair competition, breach of implied contract, breach of confidentiality, and any other legal theory relating to submissions. Thus, we will own exclusively all such right, title and interest and shall not be limited in any way in the use, commercial or otherwise, of any Comments. You should not submit any Comments to us if you do not wish to assign such rights to us. We are and will be under no obligation: (i) to maintain any Comments in confidence; (ii) to pay to you or any third party any compensation for any Comments; or (iii) to respond to any Comments. You are and shall remain solely responsible for the content of any Comments you make. By posting Comments or any other content, you warrant and represent that you own the rights to such or are otherwise authorised to post, distribute, display, perform, transmit, or otherwise distribute such Comments and content and grant us the right to do the same. You hereby irrevocably waive any claims based on moral rights and similar theories, if any.

Your Content, and the contents of all of your Comments and other online communications (including without limitation chat text, voice communications, IP addresses and your personal information) may be accessed and monitored as necessary to operate the Site and may be disclosed: (i) when we have a good faith belief that we are required to disclose the information in response to legal process (for example, a court order, search warrant or injunction); (ii) to satisfy any applicable laws or regulations (iii) where we believe that the Site is being used in the commission of a crime, including to report such criminal activity or to exchange information with other companies and organisations for the purposes of fraud protection and credit risk reduction; (iv) when we have a good faith belief that there is an emergency that poses a threat to the health and/or safety of you, another person or the public generally; and (v) in order to protect the rights or property of Racehorse Lotto, including to enforce this Agreement. By entering into this Agreement, you hereby provide your irrevocable consent to such monitoring, access and disclosure. If you do not consent to such monitoring, you should stop using the Site immediately.

When accessing the Site you agree to obey the law and to respect the intellectual property rights of others. Your use of the Site is at all times governed by and subject to laws regarding copyright ownership and use of intellectual property. You agree not to upload, download, display, perform, transmit, or otherwise distribute any information or content in breach of any third party's copyrights, trademarks, or other intellectual property or proprietary rights. You shall be solely responsible for any breach of any relevant laws and for any infringements of third party rights caused by any content you provide or transmit, or that is provided or transmitted using your Account. The burden of proving that any Content does not breach any laws or third party rights rests solely with you.

The Site is operated by Racehorse Lotto in the United Kingdom. Those who choose to access and use the Site from locations outside the United Kingdom do so on their own initiative and are responsible for compliance with applicable local laws.

17. THIRD PARTY PRODUCTS

Third party services, content, information and products may be made available by Racehorse Lotto on or through the Site (Third Party Products). Third Party Products are provided solely for the convenience of Site users and Racehorse Lotto makes no representations or warranties regarding any Third Party Products and takes no responsibility and assumes no liability for any Third Party Products. Third Party Products are subject to the applicable terms and policies of the third parties that offer them.

18. HYPERLINKS

The Site may contain links to websites operated by other parties. Racehorse Lotto provides these links to other websites as a convenience, and use of these sites is at your own risk. The linked sites are not under the control of Racehorse Lotto, and Racehorse Lotto is not responsible for the content available on the other sites. Such links do not imply Racehorse Lotto's endorsement of information or material on any other site and Racehorse Lotto disclaims all liability with regard to your access to and use of such linked websites.

You may not place a link to the Site on another website unless you adhere to Racehorse Lotto's linking policy as follows: (i) the appearance, position and other aspects of the link may not be such as to damage or dilute the goodwill associated with Racehorse Lotto and/or its names and trademarks, (ii) the appearance, position and other attributes of the link may not create the false appearance that your organisation or entity is sponsored by, affiliated with, or associated with Racehorse Lotto, (iii) when selected by a user, the link must display the Site on full-screen and not within a frame on the linking site, and (iv) Racehorse Lotto reserves the right to revoke its consent to the link at any time and in its sole discretion.

19. GOOD CAUSE CONTRIBUTIONS

Racehorse Lotto strives to support the British Horse Racing industry to ensure that the people and animals that make up this industry are treated fairly and compassionately for the enjoyment of all. To this end Racehorse Lotto will donate a portion of all paid entry fees to carefully selected good causes that support the industry.

No donations will be made in respect of entries made using the alternative postal method of entry, entries awarded to players for any referral schemes in operation, or entries awarded as a prize in any Prize Draw.

Racehorse Lotto reserves the right to change the specific good causes that it makes donations to and the portion of paid ticket sales that it donates to them at its sole discretion and without notice to you.

Racehorse Lotto does not claim ownership or affiliation with any of the good causes, their trade names, logos or intellectual property.

The portion of ticket sales that will be donated to good causes will be made available on the Site.

The specific good causes that have and will be donated to will be made available on the Site.

20. INTELLECTUAL PROPERTY

The interfaces, content, arrangement and layout of the Site including, but not limited to, the Racehorse Lotto trademark and logo, designs, text, artwork, graphics, images, buttons, user interfaces, information and other content, and any compilation of the foregoing (Racehorse Lotto Intellectual Property) are the property of Racehorse Lotto, except where otherwise noted, and are protected from copying, imitation, communication, or simulation under international laws and may not be reproduced, modified, communicated, displayed, distributed, or transmitted without the prior written permission of Racehorse Lotto. You understand and acknowledge that, by visiting the Site, you do not acquire or obtain by implication or otherwise, any licence or right to use or make additional copies of any materials or information displayed on the Site. You agree not to display or use any Racehorse Lotto Intellectual Property or third party content located on the Site in any manner not expressly permitted under this Agreement. You must not use the Site (or any part of its content) for commercial purposes.

We respect the copyrights of others and expect our users to do the same. We have a policy of terminating users who repeatedly infringe the copyrights of others. If you learn or believe that the Site or any information on the Site, including any Content, infringes upon any copyright or other intellectual property that you own or control, you may file a notice to us by emailing us at info@racehorselotto.com. In the event of any third party claim that the Site infringes that third party's intellectual property rights, we will be solely responsible for the investigation, defence, settlement and discharge of any such intellectual property infringement claim.

21. DISCLAIMER OF WARRANTIES

Except for those warranties that cannot be excluded by law, Racehorse Lotto makes no warranty as to the quality, accuracy, completeness or reliability of any content available through, or the performance of, the Site. You are responsible for verifying any information before relying on it. Use of the Site is at your sole risk. Racehorse Lotto does not warrant that you will be able to access or use the Site at the times or locations of your choosing; that the operation of the Site will be uninterrupted or error-free; that defects will be corrected; that the Site is free of viruses or other harmful components.

22. LIMITATION OF LIABILITY

Nothing in this Agreement excludes or limits our liability for: (i) death or personal injury caused by our negligence; (ii) fraud or fraudulent misrepresentation; and (iii) any matter in respect of which it would be unlawful for us to exclude or restrict our liability.

If we fail to comply with this Agreement, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms of Use or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it was an obvious consequence of our breach or if it was contemplated by you and us at the time that you accessed the Website.

If we supply you with any digital content that proves to be defective and damages a device or other digital content belonging to you, and this is caused by our failure to use reasonable care and skill, we will either repair the damage or pay you compensation.

Notwithstanding the second paragraph of this clause 22, to the full extent permissible under applicable law, Racehorse Lotto's aggregate liability to you or any third party in any circumstance shall not exceed one hundred pounds (£100).

Nothing in this Agreement affects your statutory rights. Advice about your statutory rights is available from your local Citizens' Advice Bureau or Trading Standards Office.

We only supply the Site for domestic and private use. You agree not to use the Site, or any content on the Site, for any commercial or business purposes and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

23. INDEMNIFICATION

You agree to indemnify Racehorse Lotto, and its successors and assigns, and their respective officers, directors, affiliates, agents and employees, in respect of any and all claims, actions, proceedings and suits and all related liabilities, losses, damages, judgments, settlements, penalties, fines, costs and expenses (including, without limitation, reasonable lawyers fees and costs) arising out of or relating to (i) your breach of any law, rule, regulation or rights of others in connection with your use of the Site, or (ii) infringement, violation or misappropriation of any copyright, trade secret, or any other intellectual property rights or the breach of any property or privacy right arising from any of the Content or Comments that you post on the Site.

24. GOVERNING LAW AND JURISDICTION

This Agreement is governed by the laws of England and Wales. This means that your access to and use of the Site, and any dispute or claim arising out of or in connection therewith (including non-contractual disputes or claims), will be governed by English law.

You can bring proceedings in respect of this Agreement in the English courts. However, as a consumer, if you live in another part of the UK or in a European Union member state you can bring legal proceedings in respect of this Agreement in either the English courts or your local courts.

As a consumer, if you are resident in the European Union and if we direct this Site to the member state in which you are resident, you will benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in this Agreement, including the first paragraph of this clause 24 affects your rights as a consumer to rely on such mandatory provisions of local law.

25. GENERAL

This Agreement may only be amended and/or revised in writing by Racehorse Lotto (including by publishing such revisions by Racehorse Lotto on the Site).

You agree that no joint venture, partnership, employment, or agency relationship exists between you and Racehorse Lotto as a result of this Agreement or your use of the Site.

Racehorse Lotto may assign this Agreement, in whole or in part, to any person or entity at any time with or without your consent. You may not assign this Agreement without Racehorse Lotto's prior written consent, and any unauthorised assignment by you shall be null and void.

If any of the provisions of this Agreement are found to be invalid or unenforceable, then that provision will be construed in a manner consistent with applicable laws to reflect, as nearly as possible, the original intentions of the parties, and the remaining provisions shall remain in full force and effect.

Our failure to enforce any provision of this Agreement shall in no way be construed to be a present or future waiver of such provision, nor in any way affect the right of any party to enforce each and every such provision thereafter. The express waiver by us of any provision, condition or requirement of this Agreement shall not constitute a waiver of any future obligation to comply with such provision, condition or requirement.

All notices given by you or required under this Agreement shall be in writing and should be emailed to info@racehorselotto.com.

Racehorse Lotto shall not be liable for any delay or failure in performance of any part of its obligations to the extent that such delay or failure is caused by any cause beyond its reasonable control including, without limitation, fire, flood, strikes, lock-outs, hardware, software or telecommunications failure or any government action.

Racehorse Lotto shall be entitled, without any liability on its part, to alter, suspend or terminate any of its services on the Site or otherwise to comply with any legal or regulatory requirements.

This Agreement, including the documents expressly incorporated by reference, constitutes the entire agreement between you and us with respect to the Site and supersedes all prior or contemporaneous communications, whether electronic, oral or written, between you and us with respect to the Site.

26. LOTTO PRIZE DRAW RULES

The following describes the rules and procedures by which Racehorse Lotto operates its Lotto Prize Draws and determines winners.

Prize Draw Entries

Prize Draw entries are formed by selecting numbers from a range.

Entries consist of five numbers 1-54 (Main Numbers). Each number within a single entry must be unique, that is no number may be repeated. The order in which the numbers are selected is not important for determining if an entry will win a prize.

The numbers and ranges available for selection may be amended from time to time at Racehorse Lotto's sole discretion. Any changes would only be made for future Prize Draws for which no entries have been purchased.

All entries made by a single player for a single Prize Draw must contain a unique combination of numbers. For example, a single player could not have two entries with the numbers 1,2,3,4,5 for a single Prize Draw. Two or more separate players are able to enter with the same numbers in a single Prize Draw however.

No entries from agents, third parties, syndicated entries or those made using methods such as a computer macro, script or the use of automated devices are permitted and no bulk entries are permitted.

Timing and Frequency of Prize Draws

Racehorse Lotto will perform a Prize Draw once a week on Fridays. Racehorse Lotto may amend the date, time and frequency that it performs Prize Draws at any time and at its sole discretion.

The date and time of the next available Prize Draw will always be available on the website and made known to customers prior to purchasing any entries in to that Prize Draw.

Conducting Prize Draws

Each Prize Draw will have an associated lock down time. From this moment onwards no further entries in to this Prize Draw will be possible. The winning numbers for a Prize Draw will never be determined until we have verified that no further entries are able to enter in to the Prize Draw.

Once all entries have been confirmed and the Prize Draw is locked down, Racehorse Lotto will use a certified third party random number generator service to generate six unique numbers (the Winning Numbers), in the same range as used for entries. The first five numbers generated are the Main Numbers. The sixth number generated is the Bonus Number. The Winning Numbers will be recorded and then used to determine which entries have won prizes.

Determining Winners

Once the Winning Numbers have been determined, the numbers from each valid entry in the Prize Draw will be compared to determine how many matches have been made. The number of matches made will determine whether or not a prize has been won and which prize will be awarded if a prize has been won, according to the Prize Table in the section below.

There is no limit to how many valid entries can win each of the prize tiers.

If the Jackpot Prize Tier is won by more than one player in a single Prize Draw then the prize shall be changed as follows: £250,000 cash will be divided equally amongst all of the Jackpot Prize Tier winners for that Prize Draw, rounding down to the nearest pound per winner.

An entry will always be awarded only the highest valued prize it is eligible for. For example an entry meeting the match requirements for Prize Tier 2 (four Main Numbers and the Bonus Number) will also meet the requirements for Prize Tier 3 (match four Main Numbers). In this example it would only be awarded the prize for matching four Main Numbers and the Bonus Number.

Where a Prize Tier offers more than one alternative prize the winner will be contacted to determine which of the available options they would like. Racehorse Lotto reserves the right to choose which option is awarded where one or more of the other options are not available.

Racehorse Lotto reserves the right to substitute prizes at any Prize Tier with a different prize of equal or greater value where it is unable to provide the listed prize to a winner.

Right to Amend

Racehorse Lotto reserves the right to amend these Prize Draw rules from time to time at its sole discretion. Where such amendments will affect the chances of winning or the value of the prizes available then customers will be informed on the Site and via email where applicable to allow customers to choose if they will continue to enter future Prize Draws or not.

Miscellaneous rules

Racehorse Lotto and any affiliated parties, for example good causes recipients are not responsible for illegible, lost, late, incomplete, misdirected, or undeliverable email; or for any computer, telephone, satellite, cable, network, electronic or internet hardware or software malfunctions, failures, connections, or availability, or garbled, corrupt or jumbled transmissions, service provider/internet/website/use net accessibility, availability, or traffic congestion, or any technical, typographical, or other error, or unauthorised human intervention, or the incorrect or inaccurate capture of registration information, or the failure to capture, or loss of, any such information.

By entering Prize Draws, you agree to be bound by these Prize Draw Rules and by all applicable laws and decisions of Racehorse Lotto.

In the event of a dispute regarding entries received from multiple users having the same email account, the authorised subscriber of the email account at the time of entry will be deemed to be the entrant and must comply with these rules. Authorised account subscriber is the natural person who is assigned the email address by the Internet Service Provider (ISP), online service provider, or other organisation responsible for assigning email addresses.

27. LOTTO PAYMENT AND DELIVERY OF PRIZES

Delivery of prizes to winners will depend on the nature of the prize that has been won, and where there is a choice of prizes available at a given prize tier, the specific prize selected by the winner. In the event that the selected prize is not available, another option from that same prize tier shall be provided for the winner.

Prizes that can be delivered by email will be delivered to winners using the email address they have registered with.

Winners of prizes that cannot be delivered by email will be contacted via their registered email address and/or phone number if it has been provided to us to arrange for delivery to them. Winners will not be liable for any postage costs or any other fees incurred in delivering the prizes to them. We may ask if winners would be willing to participate in a photo shoot with their prize for our promotional purposes. If winners agree then we will deliver the prize to them at a date and time that we agree upon together. Winners of physical prizes will in no way be obligated to do this. Where a Prize Tier has multiple options available then we will contact the winner via their registered email address and/or phone number if it has been provided to us first to determine which option they would like. Should the prize be unavailable, a prize of equal or greater value will be substituted. Racehorse Lotto reserves the right to substitute an alternative prize of equal or greater value. No cash prize alternatives are available for any prizes except where stated in these Terms & Conditions.

We will endeavour to provide non-cash prizes as soon as reasonably practicable. However, if we reasonably consider that we are not able to provide a non-cash prize in the form described under these Terms for reasons outside of our control (including epidemic, pandemic, disease (including equine diseases), injury or death to racehorses, cancellation or postponement of sporting events, acts of God, flood, drought, earthquake or other natural disaster, terrorist attack, riots, war, fire, explosion or accident or any law or any action taken by a government or public authority) we shall not be obliged to provide the non-cash prize to the winner from the start of such event until we reasonably consider that (i) the event outside of our control has ended; and (ii) we are able to provide the non-cash prize substantially in the form described under these Terms.

If, for any reason, a horse race in England and Wales is conducted at a racecourse that is closed to the public or otherwise subject to enhanced entry restrictions, we may, but we shall not be obliged to, provide non-cash prizes in respect of horse races that are conducted in such stadiums.

To the extent applicable for each prize, as appropriate, the period during which the winner may receive the non-cash prize may be extended by: (i) the period that we consider that the event outside of our control prevented the prize from being provided to the winner substantially in the form described; and/or (ii) the period during which horse races in England and Wales are conducted at racecourses that are closed to the public or otherwise the subject of enhanced entry restrictions.

For all cash prizes, winners will be contacted via their registered email address to provide bank account details in order to send the monies. We may also require proof of identity and to perform other checks prior to sending the money. No payment will be required from customers in order to receive any prize.

For prizes valued over approximately £100 we may require proof of identity and to perform other checks prior to delivering the prize. No payment will be required from customers in order to receive any prize.

In the event that it is not possible for us to contact a winner to arrange payment or delivery of a prize after multiple attempts, then after a period not shorter than one month from the first attempted contact the prize will be deemed to be forfeited by the winner.

If any individual element of a prize has not been claimed, booked or selected (as appropriate) by the timescale set out in this section 27, that element of the prize will be deemed to be forfeited by the winner. For the avoidance of doubt, this will not affect other elements of the prize that (i) have been claimed, booked or selected by the winner within the appropriate timescale; and (ii) the Racehorse Lotto considers are not dependent upon the forfeited element of the prize. By way of example only, if the Jackpot winner does not sign the Lease (defined below) within a period of one month of winning the Jackpot, the winner would not be able to select the racehorse colours of their choice but may still be able to receive the £30,000 in cash.

Jackpot - Sole ownership of two racehorses for one year + £30,000 cash

Two horses in training racing in your name

Racehorse Lotto will ensure that two (2) thoroughbred racehorses will be made available to race in the name and racing colours of the winner for a period of one year.

These horses will be managed under a lease agreement ("Lease") which will be signed between the racehorse owner ("Owner") and the Racehorse Lotto winner. The Lease must be signed by the winner within a period of one (1) month of winning the Jackpot. Under this agreement Racehorse Lotto will ensure that the winner has access to two (2) horses in training. If for some reason none of these horses are able to race Racehorse Lotto will ensure that there are other horse assets made available to race in the name of the winner unless the following sentence applies. If a horse is withdrawn from a race within one week of a race day for any reason Racehorse Lotto makes no guarantee that a replacement horse will be available to run in the name of the winner for that race. Where this occurs Racehorse Lotto will endeavour to identify an alternative race date.

The winner shall be responsible for the registration of the Lease with Weatherbys Racing Bank ("Weatherbys") within the applicable time frame and in compliance with the Rules of Racing of the British Horseracing Authority ("Rules of Racing"). Racehorse Lotto will ensure that the Owner shall provide such assistance as may reasonably be requested by the winner or by Weatherbys to confirm the same. Each horse leased will require a separate lease agreement to be drafted, signed and registered with Weatherbys.

The lease of the horse or horses under the Lease will run for a period of one (1) year ("Lease Period"). This contract will start from the date that the winner's due diligence and identity confirmation has been completed to our reasonable satisfaction.

Each party shall be responsible for obtaining their own insurance in respect of their potential liabilities under or in connection with the Lease.

Racehorse Lotto shall arrange for the winner to obtain and maintain at all times during the Lease Period third party liability insurance cover in the form and to the limit of liability provided by the Racehorse Owners Association as part of the Racehorse Owners Association membership forming part of this prize (membership as described below). Racehorse Lotto will pay for all the costs of such insurance and shall be liable for the payment of insurance premium. The third party liability insurance cover will cover the Owner and the winner. The winner will provide the Owner with a copy of the insurance policy document(s) promptly upon receipt.

£30,000 in cash

The winner will receive one (1) prize of a cheque for £30,000 (thirty thousand pounds) made payable in the name of the winner only. A signature and proof of ID may be required upon delivery of the cheque.

Horses stabled at a world class training facility

The horses that will race in the winner's colours will be stabled and trained with one of the UK's leading racehorse trainers ("Trainers"). The Trainers will be chosen by the Racehorse Lotto racing team and the horses shall be trained throughout the Lease Period by the Trainers. The winner acknowledges and agrees that the Trainers shall make the day to day decisions relating to the welfare, training, running, riding, stabling and transport of the horse, and that the winner shall have no rights in relation thereto.

The Racehorse Lotto will endeavour to ensure that a Trainer is selected in a location that is geographically close to the winner's home address.

All training and racing fees paid

Racehorse Lotto shall be responsible for all costs which the horse gives rise to during the Lease Period. The costs to be borne by the Racehorse Lotto shall include, without limitation, the following:

  • all veterinary costs incurred during the Lease Period;
  • all training-related costs;
  • all costs relating to the entering and running of the Horse in races, including all transportation and stabling costs;
  • the costs of keep and care for the Horse (e.g. stabling, shoeing as needed and other relevant costs) and other costs passed on by the Trainer (if applicable);
  • the cost of obtaining insurance.

Your own registered racing colours of your choice

The winner may choose their own racing colours, or 'silks'. These are the racing colours that will be worn by the jockey racing the horses won under this prize.

No two sets of colours can be exactly the same. Each racing colour submission received will be first considered by British Horseracing Authority judges and Weatherbys to ensure the colours do not clash with any other silks. The final decision on registrations rests solely with the British Horseracing Authority.

The full costs to register and purchase the colours will be borne by Racehorse Lotto.

The racing colours must be selected by the winner within 1 month of winning the Jackpot.

Exclusive access at the racecourse with four Owners & Trainers badges

By becoming the 'owner' of a racehorse under the Lease the winner will be given up to four Owners & Trainers badges to be used to access the racecourse on the days their horses are racing. These badges can be used to invite friends and family to attend racing days with the winner. These badges can only be used on the day the horse is racing at the racecourse where the horse is running.

Annual membership for two at your local racecourse for two years

The winner will also receive an annual membership for two (2) people at the local racecourse nearest to the winner's home address for two consecutive years. The membership to the racecourse will be registered in the name of the winner and one other person of their choice. This membership must meet the terms and conditions of the membership policy of chosen racecourse. The annual membership will start from the date that the winner's due diligence and identity confirmation has been completed to our reasonable satisfaction.

The full costs of two annual racecourse memberships will be borne by the Racehorse Lotto.

The annual membership must be arranged within one month of winning the Jackpot.

Chauffeur driven to a racecourse every weekend for one year

Racehorse Lotto will provide a driver and car that will be made available every weekend to drive the winner and three (3) guests to the winner's local racecourse. The driver will be only available for one (1) day – either a Saturday or a Sunday – every weekend for one (1) year. The arrangements for this driver will need to be confirmed and booked at least seven (7) days in advance with the Racehorse Lotto team. If the driver is not booked at least seven (7) days in advance, we cannot guarantee that the driver will be available and Racehorse Lotto shall incur no liability if the driver is not able on such weekend.

Hospitality boxes for you and eleven friends at two (2) Group 1 racing festivals

The winner will be able to choose two (2) Group 1 horse racing festivals to book two (2) hospitality boxes for 12 people of their choice. This includes:

  • Private hospitality box
  • Admission badges
  • Complimentary lunch
  • Complimentary bar to include beer, house wine & soft drinks
  • Transport to and from the racecourse for twelve (12) people
  • Racecards
  • Car parking

The booking for each hospitality box must be made at least three (3) months in advance of the chosen racing event, and is subject to availability at the applicable event. If for some reason the booking is unsuccessful another racing event will need to be chosen on another date. The winner can choose two (2) dates within two (2) years of winning the Jackpot. Each box booked will be made available for one (1) day only.

The booking of these hospitality boxes must meet the terms and conditions of the chosen racecourse or racecourses.

Tailored racing attire for you and a partner/friend

The winner will receive a clothing and accessory package of hats, clothing (suits or dresses) and shoes for two (2) people. The winner can choose two (2) packages. Racehorse Lotto will select a high street clothing store to provide the packages. The winner plus one (1) guest will be able to choose the clothing package from an outlet store close to their home address. This package must be claimed within 3 months of winning the Jackpot.

Luxury overseas racing holiday for two people

The winner will receive one (1) prize of a two (2) night or (4) night racingbreaks.com holiday valued at up to £5,000 (five thousand pounds). This holiday is for two (2) people. Racehorse Lotto will provide options for this holiday and separate terms and conditions will apply. The winner and their guest will be responsible for ensuring that they each have valid passports and travel insurance, and any necessary visas.

If it is not possible to source a racing holiday from racingbreaks.com then an alternative holiday package of an equivalent or greater value will be arranged by Racehorse Lotto.

This holiday package must be claimed and booked within one year of winning the Jackpot.

Racehorse Owners Association membership & subscription to the Racing Post newspaper

The winner will receive one (1) prize of an annual membership to the Racehorse Owners Association and one (1) prize of an annual subscription to the Racing Post newspaper. Both the membership to the Racehorse Owners Association and the Racing Post newspaper will be registered in the name of the winner only.

Tier 2 - Sole ownership of one thoroughbred racehorse for one season, flats or jumps

One horse in training racing in your name

Racehorse Lotto will ensure that one (1) thoroughbred racehorses will be made available to race in the name and racing colours of the winner for a period of either one flats season or one jumps season.

This horse will be managed under a lease agreement ("Lease") which will be signed between the racehorse owner ("Owner") and the Racehorse Lotto winner. The Lease must be signed by the winner within a period of one (1) month of winning the prize. Under this agreement Racehorse Lotto will ensure that the winner has access to one (1) horse in training. If for some reason this horse is unable to race Racehorse Lotto will ensure that there are other horse assets made available to race in the name of the winner unless the following sentence applies. If a horse is withdrawn from a race within one week of a race day for any reason Racehorse Lotto makes no guarantee that a replacement horse will be available to run in the name of the winner for that race. Where this occurs Racehorse Lotto will endeavour to identify an alternative race date.

The winner will receive one (1) prize of a cheque for £10,000 (ten thousand pounds) made payable in the name of the winner only. A signature and proof of ID may be required upon delivery of the cheque.

Your own registered racing colours of your choice

The winner may choose their own racing colours, or 'silks'.

No two sets of colours can be exactly the same. Each racing colour submission received will be first considered by British Horseracing Authority judges and Weatherbys to ensure the colours do not clash with any other silks. The final decision on registrations rests solely with the British Horseracing Authority.

The full costs to register and purchase the colours will be borne by Racehorse Lotto.

The racing colours must be selected by the winner within 1 month of winning the prize.

Annual membership for two at your local racecourse for one year

The winner will also receive an annual membership for two (2) people at the local racecourse nearest to the winner's home address for one year. The membership to the racecourse will be registered in the name of the winner and one other person of their choice. This membership must meet the terms and conditions of the membership policy of chosen racecourse. The annual membership will start from the date that the winner's due diligence and identity confirmation has been completed to our reasonable satisfaction.

The full costs of two annual racecourse memberships will be borne by Racehorse Lotto.

The annual membership must be arranged within one month of winning the prize.

28. PROMOTION OF LOTTO WINNERS

The names and likenesses of Prize Draw winners may be used by Racehorse Lotto or its affiliates for promotional purposes. This will be subject to the consent of the winner. Where this consent has been given, winners will not be entitled to any further compensation for the use of this content in any promotional materials published on or offline.

29. ON THE NOSE GAME RULES

The following describes the rules and procedures by which Racehorse Lotto operates its On The Nose Prize Draws and determines winners.

Entry to an On The Nose Prize Draw is free. Payment is not required to enter or to find out if a prize has been won.

Entry to an On The Nose Prize Draw requires the creation of an Account.

A maximum of one entry per valid Account is allowed per On The Nose Prize Draw. Where it is detected that a player is attempting to circumnavigate this restriction through the creation and use of multiple Accounts Racehorse Lotto reserves the right the terminate such Accounts and make any On The Nose entries or prize wins associated with those Accounts null and void.

On The Nose Prize Draw Winners will be notified by email. In the event that it is not possible for us to contact a winner to arrange payment of a prize after multiple attempts, then after a period not shorter than one month the prize will be deemed to be forfeited by the winner.

Each On The Nose Prize Draw image will have a single set of pre-defined x and y pixel coordinates (Winning Coordinates) that represent where the tip of the horse's nose was before the image was altered to obscure the horse's head. Where an image has more than one horse in it, the Winning Coordinates are for the tip of the nose of the single horse that has head its head obscured. The first prize will be awarded to the entry with the closest coordinates to the Winning Coordinates. The second prize to the next closest and so on. Where multiple entries are equidistant from the Winning Coordinates and eligible for a prize then the prize will be awarded to a single randomly selected entry from those entries.

Delivery of Prizes

Cash prizes will be awarded to players either via PayPal or via bank transfer. Winners will be contacted via email to request appropriate details to enable the transfer of funds.

Racehorse Lotto Ticket prizes will be awarded to players automatically. Winners will be notified of their prize wins and tickets by email.

Racehorse Lotto reserves the right to alter the dates, times and frequency at which it makes On The Nose Prize Draws available.

Racehorse Lotto reserves the right to amend these On The Nose Prize Draw rules from time to time at its sole discretion. Where such amendments affect the prizes available to be won, the new prizes will be made clearly available on The Site.

Racehorse Lotto reserves the right to substitute any prizes with a different prize of equal or greater value where it is unable to provide the listed prize to a winner.

By entering an On The Nose Prize Draw you consent to your first name and the first letter of your surname being published on The Site.

Employees, agents, successors, and assignees of Racehorse Lotto, its advertising agencies and promotional companies involved in any of the Prizes Draws on the Site, as well as family and household members of same, shall be ineligible to participate in and ineligible to win prizes in any of the On The Nose Prize Draws made available on the Site.

30. TAXATION OF PRIZES

All prizes won from entries sold in the UK are tax free.
